Terms and Conditions
1.1 Irrespective of the age of the student who receives tutoring session(s), the contractual relationship is between The Learning Hub Limited and the student’s parent or (if more than one) the parent who pays for the tutoring sessions on behalf of the student or (as the case may be) the student’s guardian who pays for the tutoring sessions.
1.2 These Terms and Conditions apply to the contractual relationship between The Learning Hub Ltd and the parent/guardian. If the parent or guardian funds tutoring sessions for more than one student, these terms and conditions apply separately to each student.
1.3 The Science Learning Hub, Learning Hubs and the Learning Hub Ltd shall hereafter be referred to as The Learning Hub Limited, which is the legal entity. The parent(s) or guardian(s) shall hereafter be referred to as ‘you’ or ‘your’. The student shall hereafter be referred to as ‘the student’.
1.4 The Learning Hubs Ltd reserves its right to change these Terms and Conditions as and when necessary. The applicable Terms and Conditions will be published on this website.
1.5 Paras 1, 4, 5, 6, 7 and 8 apply to all contracts. In addition, para 2 applies in the case of Revision Sessions and para 3 in the case of regular tutoring sessions.
1.6 In addition, Para 7 (Use of Website) of these Terms and Conditions shall apply to all those who access or use this website or use the information displayed on the website. Access and perusal of this website will be deemed to be acceptance of these Terms and Conditions. For the purposes of Para 7, ‘you’ and ‘your’ shall refer to the person who accesses or uses this website or uses the information displayed on the website.
- Enrolling in Revision Sessions
2.1 When enquiries are made or interest shown for revision sessions, the name is added to a provisional list.
2.2 You are responsible for confirming that the student is still interested in the session in question and that you wish to enrol the student in the days that follow. A member of the team working for The Learning Hubs Ltd will make contact with you. Once this is done and interest is confirmed, payment must be made to secure a place.
2.3 Unless payment is made to secure a place, you must not assume that a place has been secured. As revision sessions are in small groups, you are advised to make payment once you have confirmed your interest is enrolling the student to avoid disappointment.
2.4 All payments must be made at least a week in advance of the revision sessions. Confirmation of booking will only be made when payment has been received. Places will be allocated on a ‘first come, first serve basis’, payments received first will receive confirmation before others who have not made a payment although interest maybe shown earlier.
2.5 Once tutoring sessions in a revision programme have commenced, no refunds will be made for any missed sessions or for cancellation of the student’s place in the revision programme. This is because The Learning Hubs Ltd will have made payment for hiring the premises and the place could have been taken up by another student for the revision sessions. However, in the case of missed sessions, The Learning Hubs Ltd will ensure that the student is given the missed work for his or her study at home on their own.
2.6 In the event that a student is withdrawn by The Learning Hubs Ltd pursuant to para 5.6 below, an amount of tutoring fees will be refunded after deducting the fees of tutoring sessions already attended by the student.
- Enrolling in regular tutoring which could be either weekly tutoring in groups or One- to- One tutoring(Bronze, Silver and Gold and Gold+)
3.1 Regular tutoring is booked for the month (i.e. 4 sessions) and paid for in advance together with a deposit of a cost of a tutoring session.
3.2 A minimum of seven days’ notice must be given in order to cancel a session. If no notice is given or notice is given for a period less than seven clear days, the parent/guardian remains liable to pay for the session in question and agrees that the cost of the session may be deducted from the deposit held.
3.3 If a deposit has been used to cover such a missed session, the parent/guardian must make payment of a further deposit (equalling the cost of a tutoring session) before tutoring can be continued.
3.4 If sufficient notice is given to miss a session, a credit for the missed session will be given which can be used towards future tutoring sessions in the next month.
3.5 The deposit will be returned, after deduction of any amount due to The Learning Hubs Ltd pursuant to para 3.2 above at the end of your tutoring requirements. Alternatively, the parent/guardian may opt to credit the deposit towards future tutoring sessions.
3.6 Tutoring sessions can be ended by giving one month’s notice in writing to The Learning Hubs Ltd. If such notice is given, any monies held for tutoring sessions already paid for and which have been cancelled by such notice in writing will be refunded, less any deductions due to be made pursuant to para 3.2 above.
3.7 In the event that a student is withdrawn by The Learning Hubs Ltd pursuant to para 5.6 below, In the event that a student is withdrawn by The Learning Hubs Ltd pursuant to para 5.6 below, an amount of tutoring fees will be refunded after deducting the fees of tutoring sessions already attended by the student.
- Cancellation of Sessions by The Learning Hubs Ltd
4.1 The Learning Hubs Ltd has the right to cancel any tutoring session if sufficient numbers of students do not make the session viable. Full refund of monies will be made if sessions are cancelled by The Learning Hubs Ltd, less any deductions (if applicable) in respect of missed sessions, any liability on your part pursuant to para 5.5.1 and any adjustments due: (i) (in the case of revision lessons) under para 2.6; or (ii) (in case of regular tutoring) under para 3.7.
- Your responsibility as a user of services offered
5.1 You acknowledge that you will make your own judgement as to whether to take up the tutoring sessions.
5.2 Whilst The Learning Hubs Ltd takes its commitment to tutor students in order to improve their performance seriously, it is not liable if the sessions do not meet your expectations. However, The Learning Hubs Ltd will make reasonable efforts to investigate any complaints and, if possible, make required improvements and adjustments. We aim to ensure that each student benefits from every tutoring session. We encourage those using our services to communicate any matters of concern as early as possible. Student and parent/guardian feedback is an important element of our ethos.
5.3 You must ensure that the student respects and does not damage or steal any property belonging either to the institution or entity from which the premises have been hired or the Learning Hubs Ltd. These include but are not limited to furniture, furnishings, computers, writing boards and any stationary etc.
5.4 You must ensure that the student abides by all the terms and conditions applicable to the use of the premises on which tutoring is carried out.
5.5 In the event that a student is in breach of para 5.3 and/or 5.4:
5.5.1. You will be liable to pay for any loss or damage arising as a result.
5.5.2 The Learning Hubs Ltd reserves its right to remove the student from all future tutoring sessions. We hope that this will not be necessary and we ask you to ensure that the student respects the tutoring premises and any property contained therein.
5.6 In addition, if the student is disruptive, The Learning Hubs Ltd reserves its right to withdraw him/her from all future tutoring sessions. Before such action is taken, The Learning Hubs Ltd will bring such disruptive behaviour to the attention of the parent/guardian and make a reasonable attempt to persuade the student to desist from such behaviour. In deciding what is reasonable, The Learning Hubs Ltd shall be entitled to take into account its duty to other students in the tutoring session(s).
- Data Protection
- Use of website
7.1 All materials used in the website wholly belong to The Learning Hubs Ltd unless otherwise stated. All materials are the intellectual property rights of The Learning Hubs Ltd unless otherwise stated and must not be copied or reproduced in any way unless written permission is obtained from The Learning Hubs Ltd.
7.2 You acknowledge that all materials on our website and/or all intellectual property rights of The Learning Hubs Ltd are protected by both the laws of England and Wales and international laws protecting intellectual property rights.
7.3 You will be held responsible for any losses or damages arising as a result of any breach of the intellectual property rights of The Learning Hubs Ltd by you and/or the student.
7.4 Whilst every effort is made to ensure accuracy of information, The Learning Hubs Ltd is not liable for any mistakes made or consequences arising from the mistakes.
7.5 The Learning Hubs Ltd is entitled to make changes to its website without giving any prior notice.
7.6 When interacting and using the website or in any communications with staff or teachers or contractors of The Learning Hubs Ltd, you undertake that you will not use or write abusive, racist, obscene, provocative, illegal or any unacceptable language. You further undertake to ensure that the student does not use or write abusive, racist, obscene, provocative, illegal or any unacceptable language.
7.7 In the event that The Learning Hubs Ltd considers that behaviour contrary to Para 2.6 has occurred, The Learning Hubs Ltd shall be entitled to deal with the matter in the following ways although not limited to these:
7.7.1 If the behaviour is illegal, report it to the relevant authorities in accordance with the law;
7.7.2 Removing such content without the permission of the writer; and
7.7.3 Prohibit future content and/or communications by the perpetrator.
- Law and Jurisdiction
8.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England, irrespective of the location in which tutoring sessions are delivered. The parties submit to the jurisdiction of the courts of England.
